Menara Bike Marrakech – E-Bike Self-Guided Tours

⚠️ IMPORTANT: By making a booking, you fully accept these Terms and Conditions. Please read them carefully before booking.

§1 Scope and Contracting Parties

These Terms and Conditions apply to all bookings and rental agreements between:

Provider: Menara Bike, Faissal Algouti
Renter: The natural person making the booking (customer)

By completing the booking, the renter expressly confirms that they have read, understood, and accepted these Terms and Conditions in full.

§2 Scope of Services

Included in the rental price:

• E-bike rental for the booked duration (approx. 3 hours)
• Helmet (mandatory – no exceptions)
• PDF route guide in the selected language
• Audio tour accessible via link
• Google Maps route for smartphone navigation
• Delivery to the agreed meeting point
• Pickup at the last stop of the route

Not included: entrance fees to attractions, food and beverages, mobile data, personal insurance.

§3 Booking and Payment

Bookings can be made via the website, WhatsApp, or booking platforms (GetYourGuide, Viator, Airbnb Experiences, Civitatis, Headout, Klook). A booking becomes binding once confirmed in writing by the provider.

Payment is made exclusively on-site in cash upon delivery of the e-bikes.

Accepted currencies:

• Moroccan Dirham (MAD)
• Euro (EUR) at the daily exchange rate

Online payment is currently not available. The booking itself is free of charge and does not require a credit card.

§4 Cancellation and Changes

Free cancellation: up to 24 hours before tour start via WhatsApp or email
Cancellations less than 24 hours before the tour are non-refundable.
Weather conditions: If cancelled by the provider, no costs are incurred by the renter.
Weather conditions: If the renter cancels due to weather conditions, no refund will be issued.
Changes (date, time): free up to 24 hours in advance, subject to availability thereafter.

§5 Renter Responsibilities and Obligations

⚠️ The renter is solely responsible for their behavior in traffic and the safe use of the e-bike.

The renter expressly agrees to:

• Wear the helmet at all times – no exceptions
• Comply with all applicable traffic laws of the Kingdom of Morocco
• Use the e-bike only on suitable routes as intended
• Not leave the e-bike in direct sunlight
• Park only in safe and designated areas
• Not ride under the influence of alcohol or drugs
• Return the e-bike at the agreed time
• Immediately inform the provider in case of breakdown, accident, or theft
• Not carry additional passengers on the e-bike

§6 Renter Liability

The renter is fully liable for:

• Any damage to the e-bike due to improper use, negligence, or violation of these Terms
• Full replacement cost in case of theft during the rental period
• Damage caused by parking in direct sunlight
• Any damage resulting from breaches of §5

Normal wear and tear is not considered damage. A rental agreement specifying liability details is signed upon handover.

§7 FULL EXCLUSION OF LIABILITY OF THE PROVIDER

⚠️ THE PROVIDER EXCLUDES ALL LIABILITY TO THE EXTENT PERMITTED BY LAW.

7.1 Personal Injury

The provider is NOT liable for:

• Injuries, accidents, or death of the renter or third parties during the rental period
• Damage caused by improper behavior in traffic
• Damage caused by failure to comply with traffic rules or safety instructions
• Damage caused by not wearing a helmet
• Damage caused by unsuitable footwear or clothing

Use of the e-bike is entirely at the renter’s own risk.

7.2 Property Damage

The provider is not liable for:

• Loss, theft, or damage of personal belongings
• Damage to smartphones, cameras, or other devices
• Damage caused by falls or collisions

7.3 Technical Defects

The provider is not liable for:

• Damage due to technical defects not caused by proven lack of maintenance
• Consequential damage due to battery failure, flat tire, or brake issues
• Costs incurred due to breakdowns (e.g., taxi costs)

7.4 Force Majeure and Weather Conditions

The provider is not liable for damages caused by:

• Natural disasters, earthquakes, floods
• Extreme heat, rain, or other weather conditions
• Political unrest or governmental orders
• Road closures or unforeseen obstacles

7.5 Route Materials and Information

The provider is not liable for:

• Incomplete or outdated information in PDF guides or audio tours
• Closed attractions or changed opening hours
• Technical issues with audio tour or Google Maps access
• Navigation errors or route deviations
• Losses due to incorrect tour information

7.6 Booking Platforms

The provider is not liable for technical issues or failures of booking platforms such as GetYourGuide, Viator, Airbnb Experiences, Civitatis, Headout, or Klook.

7.7 Maximum Liability Limitation

Where liability cannot be fully excluded by law, it is limited to the rental price paid for the respective booking.

Liability for lost profits, indirect damages, consequential damages, or financial losses is excluded.

§8 Safety Rules (Tour Safety Rules)

The following safety rules are binding and confirmed in writing upon handover:

BEFORE THE RIDE:

• Put on helmet and ensure proper fit
• Check e-bike for visible damage
• Check battery level
• Ensure smartphone is charged and connected
• Bring cash for possible entrance fees

DURING THE RIDE:

• Always wear helmet – no exceptions
• Strictly follow traffic rules
• Adapt speed to surroundings, especially in the Medina
• Pedestrians always have priority
• Do not use smartphone while riding
• Turn on lights when riding at night
• Avoid narrow Medina streets where possible or ride very slowly
• Watch out for children, vendors, and animals

PARKING AND STOPPING:

• Only park in official and safe areas
• NEVER park in direct sunlight
• Always secure/lock the e-bike when unattended

§9 Right of Withdrawal and Consumer Rights

As this is a service provided at a specific time, the following applies:

The statutory right of withdrawal for consumers (EU Directive) does not apply to leisure services scheduled for a specific date in accordance with Art. 16(l) of EU Consumer Rights Directive 2011/83/EU.

Only the cancellation policy in §4 of these Terms applies.

§10 Data Protection

Personal data is processed in accordance with our privacy policy available at www.menarabike.com/datenschutz.

§11 Applicable Law

The laws of the Kingdom of Morocco apply. Place of jurisdiction is Marrakech, Morocco.

§12 Severability Clause

If any provision of these Terms and Conditions is or becomes invalid, the validity of the remaining provisions shall remain unaffected. The invalid provision shall be replaced by a valid one that most closely reflects its economic intent.
